Mr. Titley, in ND all permits show up as confidential wells on the GIS map. If one does a well search on the NDIC O&G Division website for one of these permitted wells the operators name and well location are what you will find if the well is not spud. If the well is spud there will also be the spud date. Lately, practically all permits for wells are confidential in ND even SWDisposal wells, water wells, besides oil and gas. The true 6 month confidential period for a drilled well does not begin until the operator requests it and a date will appear on the confidential well list for when the well's information will become public. In essence permits are confidential wells that have just not been drilled yet, until the permit expires or is cancelled. I hope this clears up how Kathy got to confidential permit. In some ways ND is like a whole nother country, to quote someone else whose name I can't recall at this moment.
I am still awaiting a call back from Continental after 3 calls and 4 months. Sometimes they will call right back and other times your never hear from them.
Kathryn, were all these minerals conveyed to you by your relatives or probated, if not it will create a title issue. They will lease but not pay without a marketable title.
I'm sorry to hear Continental won't contact you back Joe. They used to get back to me fairly quick, but then they still needed my signature and they never got it.

Ok, now on the subject on Continental, how are they part of Diamond Resources. We just got a small payment of a lease for my aunts section. Section 34. I think now that I understand more we could have counter offered for a larger bonus than $500. It's a 1/4 section in 34. Off hand I don't know what the lease arrangement was. I will have to read up on it tomorrow. I know they have a confidential permit on the map for section 34. (the check payment was from Diamond Resources.)

Kathy, Diamond Resources does alot of leasing for Continental Resources, Diamond acts as landman. Was the payment lease bonus or a royalty check?
Hi RW, it was a bonus deal done in early December/12. Separate from the lease we did in 2010. The lease we did in 2010 I believe was only for my Dad's mineral rights. Reason being my aunt who we have a portion of rights for "willed" to several family. So the deal in 2010 was taking so long to finalize because they couldn't get a hold of all who had interest in Aunt Dagmars. So we settled on lease for just my Dad's. You say you have title on the mineral rights and you talk of your dads and an aunt and settling on a lease, when I said marketable title and you said you have title, you have either had all the interest deeded to you from your father and aunt or probated each estate interest to you correct?
Joe, it is my understanding that Katheryn has probated her parents estates and has deeds in her name for minerals inherited from them.
Karhryn may also be heir to her uncles minerals and not yet have title, but neither has she given a legal description or said she has leased those minerals.
I just caught the words fathers and aunts and could not get hold of heirs and so it didn't sound like it was of record and I have had many believe and say they were of record when they really didn't have marketable title. Continental is real picky.
It sure never hurts to caution someone that they need to keep their title marketable if they expect to be paid. I wish there were a way to let all mineral ownes know before they ever get the lease offer on that 1/2 acre that it may take all of the bonus and 2 years worth of royalty to do a probate so their title would be good enough so they could receive royalty payments or interest on late payments.
All I can say is that my siblings and I know and have updated the title for my fathers mineral rights we inherited. My aunts was given to us in her will. K

If your aunts estate and your fathers estate was probated in North Dakota , recorded there and copies sent to Continental then all should be good and no problem there.

You have been fortunate in having R W and Joe respond to your request for help. They are two of the best The Forum has to offer when a Mineral Owner has a question.
One thing I would like to add:
When you need to request updates of records for Royalty Division Order "change overs" or Transfers, you have to, of course, submit certified copies of the Probate Matters, Certificates of Death, Affidavits of Heirship or whatever else is required.
But you may have to submit those documents to whatever company(ies) are purchasing the produced product(s) and disbursing the funds, rather than (just) the Operating Company.
Most regularly, one company will be purchasing the oil and/or condensate and another company the gas. I have even seen situations where more than one company is purchasing percentages of each.
You need to review your Father's and Aunt's financial records and determine which companies they were receiving checks from over the last few years. You should check back several years, as Leases and Royalty Division Orders typically have provisions whereunder payments are disbursed only when Royalty Payments due reach a certain monitary amount, such as $50.00 or perhaps as much as $500.00.
The Purchaser(s) / Disburser(s) might have changed over time, and you may have "present day" companies to contact, but the companies your Father and Aunt were receiving checks from over the past few years will be the companies you need to contact first - they may have Royalty Payments for you, held "In Suspense" while the respective Probate Matters were being resolved.
What I am trying to explain is that in order to have the proper Transfer Orders prepared for your inherited interests, you may have to submit certified copies of whatever documents are required to several companies, not just the Operator.
Just wanted you to be aware of this -

Thanks Charles! Wow, I had no idea it could be more than one company we would get checks from. Charles, I believe we are the first in the line of family to have had any active wells producing. I know back in 1985, Diamond resources leased the mineral rights, but nothing that we know of came of the lease. Until a new lease in 2010. I will for sure share this with my brother and Sister.
