I would like to pass down (or at least give instructions to my kids) how to go about putting all mineral rights in their names when I am gone. I do not own the land, just the mineral rights and receive a very small amount each year. I also pay a small amount of taxes on those mineral rights. Any suggestions? Thanks
This is not legal advice, but there are several options: Transfer on Death Deed, Conveyance reserving a Life Estate; putting the interest into a Trust; or Conveying to them & yourself as Joint Tenants.
You need to consult with an Estate Planning Attorney who can draw up the paperwork as you wish. But, it should be done BEFORE you are gone so you can avoid probate.
