If a directional drilling rig is on one property, but the bottom of the well is under another, who gets the royalties? For future users searching this topic, if it’s different in Texas, what happens there?
The answer can depend on whether a well is drilled as part of a pooled unit or is an allocation well. In general terms entitlement to royalties depends on the point of production, as determined by the take points or perforations in the horizontal leg, rather than the location of the drill site or penetration point.
How would my sibs and I search OCC Escrow Account for unidentified heirs (mineral rights) if they do not know our names? Would our property be in this? Logan County, OK (heirs out of state)
Would we need landman and/or surveyor services? We just need to know where to start.
Thank you
Patricia:
I think you might have posted to the wrong area. You replied to a question about directional well ownership (Who owns directional well rights?). There is an area here in Mineral Rights Forum called Oklahoma Mineral Rights that might have people with knowledge who would see your question if you post it there. In addition, the OCC has a web page that might help: https://oklahoma.gov/occ/divisions/oil-gas/mineral-owners-escrow-account.html I know that, generally, a landman is the person who is hired most often to search county records for owners of rights.
Patricia2- search under the name of the record title owner at the OCC escrow division and the Oklahoma unclaimed property division of the Secretary of State.
