This question just occurred to me & I’m wondering if anyone has an answer. There are some wind turbines located on some of the acreage that I on which I own mineral rights. Would that be a deterrent to leasing? Or, does that even matter. I don’t own the surface, just minerals. Thanks.
Greetings, I can only speak for what I did. I own land that I leased to a wind company. I also own some of the minerals under it. I negotiated language that I hope will be adequate for future explorations and leasing. Some of the wind companies try to limit drilling to 45 days. That does not work for my part of the world. You may be at the mercy of the surface owner and the lease he signed. But, I do think and maybe this has been tested in court. I don’t see how a wind company can hinder mineral owners right to exploration and lease. Regards.
The mineral rights have dominance over the surface rights. But better to contact an attorney if it becomes an issue.
