I forgot to talk about the duration of the lease. 3 years with 2 year option seems to be the most common. If possible get the OPTION removed and try to get the shortest lease possible. Once they drill, they pretty much have the minerals forever.

Thank you for your help, we have no plans on selling any of our surface or mineral rights, but are now wondering if her proximity to well should have gotten her some royality money. How can we find that out, and is it a problem that it is still all in my dads name, but not her name.

If you have a good deal of acrage I think it would be easier to negoiate. Some folks by pass the landman and negoiate with the operator.

You should get the title move to your mothers name and filed at the court house.

It has been a couple of years since XTO has done anything in Section 29 or 30. There muist be about 70 wells in different stages around our sections.

I noticed that in my pooling, which I was not part of, someone participate at rate of .00001% of her mineral interest.
Also there where 3 options, $450 @ 1/8, $400 @ 3/16, and $0.00 @ 1/5.
He is on the spacing but not on the pooling. I could find no lease or any thing that would hold it by production. Also it looks like they are going to drill some more wells. They may have to pool your Mom if they missed your Dad ,which could be a good things.

I found the pooling for our well. I would have been better off if I had waited. It looks like I was one of the early ‘victims’ of signing a lease. I had no idea what I was doing and took the advise of an Ardmore Attorney. So now that I have a little more kownledge I think I would hold out for the force pooling. But, you have a choice I didn’t know about. We have 3 areas of mineral rights and I should have tried to get 3 seperate leases with differenet bonus and payments.
When you are force pooled you have two options: 1 participate in the cost and the production based on your percentage in the section. 2. A judge will give you the going rate based on what nearby mineral owners received . Number 2 is a double edged sword. You might go high or you might go lower on your bonus
The rate is based on the leases in the 8 units around the one being pooled. You can participate with any part of your interest and take a different options with the other.
Here is the document I was referring to on pooling. This mineral owner elected to take a small interest in participation and a 1/5 interest at zero bonus.
I think it would be interesting to find out how the state has access to the lease information. Who would have that info other than the operators?
