Assuming all is well with your title, they should have sent you a division order. You don’t have to sign a DO to get paid, but operator has to know your interest. I use NARO (NADOA) Division Order and http://www.nadoa.org/forms/div_ord.pdf You might consider sending the DO along with a letter stating their royalty interest check is not timely, nicely demand the statutory 12% interest and immediate payment of all production royalties due from backlog and current production sales including and ask for a copy of the calculations and attach a copy of Oklahoma §52-570.10 as set forth below.
B. 1. Proceeds from the sale of oil or gas production from an oil or gas well shall be paid to persons legally entitled thereto:
a. commencing not later than six (6) months after the date of first sale, and
b. thereafter not later than the last day of the second succeeding month after the end of the month within which such production is sold.
D. 1. Except as otherwise provided in paragraph 2 of this subsection, where proceeds from the sale of oil or gas production or some portion of such proceeds are not paid prior to the end of the applicable time periods provided in this section, that portion not timely paid shall earn interest at the rate of twelve percent (12%) per annum to be compounded annually, calculated from the end of the month in which such production is sold until the day paid.

I thought I had seen a report that American Ent had a producing well in 23 18n 4e and a permit to drill another one. Now I can’t find that info. Can someone tell me where to find stuff like that? Thank you

I received a notice for a hearing on 8-26-14 with the OCC about pooling 31-18n-3e. Then today I received a letter that proposed drilling a well and asking me to choose one of three options. I thought they would wait till after the hearing to send anything out???

Joyce, If you inherited the minerals, it may be that you need to probate the decedent’s estate, but there can be other clouds. ‘Cloud’ means defects (problems) and these defects are usually explained in the Division Order Title Opinion that was prepared by the oil and gas company attorney. You might try calling the operating company and ask for the division order department, give them the legal description of your minerals and ask them if they can give you some idea of the title defect clouding your title. The companies are very busy, so you might not get any help and will have to hire an attorney to legally ‘cure’ (clear up) your title and prove you are 100% owner.

G Win, you don’t have to lease to American Energy. If you like Calyx’s offer you have the right to lease to them. I always call each company offering to lease my minerals and ask for a better offer than they send in writing. I most often get a bonus amount per acre and 1/4th royalty. The wording of your lease is extremely important because it sets legally binding conditions on the Lessee you choose. However, if you don’t want to lease you can wait for the OCC pooling order and hopefully will be allowed better bonus and royalty interest than in your proposed well letter.
